Terms and Conditions

The following conditions apply to the sale of goods & services by Alex Phillips Printing Services Ltd, trading as Promotional Gods. No alterations, additions to, nor any part of these conditions shall be valid in law unless specifically agreed in writing. Nothing in the buyer's terms of purchase shall override, cancel or modify the terms below. Payment and/or approval of any order online or offline constitutes acceptance of these terms and conditions.

Settlement
Our standard terms are full payment prior to order unless prior credit terms have been agreed.
For account customers, payment must be made on or before 30 days following the date of invoice.
For public sector clients, we reserve the right to defer commencement of the job until we have received an official purchase order from the relevant purchasing authority. Please note, lead times may be affected.
Charges will be made on overdue accounts at our discretion (including goods awaiting collection for over 30 days) in accordance with 'Late Payment of Commercial Debts (Interest) Act 1998' (See: www.legislation.gov.uk/ukpga/1998/20/contents): Currently 8% interest above bank base rate from date of original invoice. Compensation: £40 below £1000, £70 below £10,000.
Director(s) of limited companies will be held personally liable for any unpaid debt.

Cancellation
Whole or partial cancellation of order can only be accepted with the consent of Promotional Gods and on terms which indemnify Promotional Gods against loss. The client will be charged any costs incurred up to that point.

Delivery
Completion/delivery dates and turnaround times quoted are estimated and not guaranteed. Whilst every effort will be made to meet deadlines, no liability will be accepted or refunds owed for unforeseen delays in supply, production, delays at customs, courier problems etc. The client should always allow ample time for completion of orders.

Proofing
It is the client's sole responsibility to check both orders & proofs for errors and omissions. Promotional Gods bears no liability for costs incurred due to unnoticed errors whether made by the client or Promotional Gods  Any re-prints will be purely at the client’s expense.

Artwork Charges
We offer a full graphic design service. This is chargeable at the prevailing rate, currently 45p per minute / £27.00 per hour (+ VAT where applicable). For most of the small promotional products on our website, a limited amount of time (e.g. 5-10 minutes) is allocated free of charge at our discretion to create a visual for proofing. This presumes you have supplied a suitable logo file as per our artwork guidelines. Anything more than that is chargeable and we shall advise you on receipt of your instructions / files. For instance: recreating a design from a low resolution image, supplying multiple proofs for your consideration, tracing/converting bitmap files to vector files, designing logos, searching/identifying fonts & images. We reserve the right to increase such charges from any original design estimate if the work takes longer than expected.

Damage or Loss in Transit
The client is responsible for examining all goods at the time of delivery in the presence of the courier before signing for them. Any claim for damage, shortages or faulty goods must be received in writing within 5 days of receipt of goods. We shall not be liable for any loss or damage caused to the goods in transit which fall outside the courier’s standard terms and conditions of liability.

Title
The risk in the goods shall pass to the client upon delivery, but ownership thereof shall remain with Promotional Gods until payment in full has been made. In the event of non-payment Promotional Gods or our agents will be entitled to enter the client's premises to confiscate the property in lieu of (but not instead of) payment. The client may not return goods as an alternative to or contribution towards payment.

Manufacturing Tolerances
Due to the nature of the various processes, exact quantities/sizes/materials/colour accuracy etc cannot always be guaranteed on every job and every product. We shall be deemed to have fulfilled our contract with a tolerance of +/- 5% on all aspects.
Certain products, in particular carrier bags, have an industry standard quantity tolerance of +/- 10% and clients will be charged extra or credited accordingly.

Limit of Liability
Promotional Gods will not be held liable for damage or injury caused by its goods or workmanship beyond replacement of the goods or work on verification of the buyer's complaint. Promotional Gods shall not be liable any consequential loss caused by its failure or delay in supplying goods whether the loss arises from the actions of or from omissions by the company its employees or agents.
If supplying your own garments or other materials for Promotional Gods to print, embroider or alter in any way you do so at your own risk. Occasionally there are rejects. Please supply spares to allow for this. Promotional Gods bears no liability for costs incurred replacing goods supplied by the client.

Advice, Information & Opinion
Advice, information & opinion given by any partner, employee or agent of Promotional Gods is given without legal responsibility. Any recommendation or suggestion made by Promotional Gods relating to the use of goods is made in good faith but it is for the clients to satisfy themselves of the suitability of the goods for their particular purpose and they shall be deemed to have done so.

Prices
No prices on our website are binding. They are guide prices only and subject to amendment at any time. All estimates are an interpretation of information received - they do not form a binding contract and are valid for 30 days only unless stated otherwise. Due to regular fluctuations, estimates for imported electronics such as USB pen drives are valid for 3 days only. Promotional Gods reserves the right to decline or cancel orders at its own discretion at any point if it transpires that costs are more than expected for any reason.

Force Majeure
Promotional Gods will not be held responsible for failure or delay in the carrying out of our obligations under the contract arising out of any cause outside our reasonable control or by inability to procure materials or articles except at higher prices due to any such cause and in such circumstances we shall be entitled by notice to terminate the contract in whole or in part without incurring any liability.
